Government Law

In the United States, Administrative and Government law is broken into several interrelated parts. They include the following:

Administrative rules, regulations and procedures for government agencies and bodies

The scope of Agency authority

The enforcement of Agency powers

Government law encompasses such subjects as Environmental Law, Public Contracts, Social Security, Agricultural Law, Civil Rights, Education Law, and Military Law.

Environmental law is concerned with governmental regulations that concern land use ordinances, protecting the environment, enforcement of building codes, condemnation policies and restrictions regarding public safety.

Public Contracts can include Procurement contracts, "Full and Open Competition" contracts, Federal Grants, or Cooperative Agreements. Generally, at least, these are the forms of agreements between the government and individuals.

Most of us know what Social Security is, but few of us really understand its original intent. Social security was a system that was implemented to act as a safety net for citizens of the United States. It is a supplement to one's retirement or disability benefits. The intent in instituting this program was to provide security for the aged, survivors, and disability insurance benefits to workers and their families. It was also intended to protect individuals from unforeseen catastrophes.

Agricultural law includes the law of contracts, torts (a civil wrong or injury, with the exception of breach of contract), environmental law (both state and federal), property law, nuisance law, wills and estates, tax law, and of course, agricultural law. Originally, this country was all about farmers and ranchers, after all! Thus, the U.S. Department of Agriculture (USDA) came into being. In fact, it is the USDA's role to provide farmers with information about farming, agricultural commodity pricing and farm income, and other agricultural issues. The USDA has the authority to address agricultural issues, undertake special studies of interest to farmers (etc.), conduct research, carry out investigations, and to perform other information-gathering activities in the interests of farmers and ranchers, as well as (for the benefit and safety of) the general public. The USDA works together with state, federal and local governments to protect consumers, and aid farmers, and ranchers.

Civil rights are enforceable rights or privileges granted by a governmental agency. If someone interferes with our civil rights, we have recourse, thanks to the statutes that have been enacted by the U.S. constitution to protect these rights. These statutes include laws that are intended to protect every United States citizen from discrimination based on race, religion, gender, marital status, disability, sexual orientation, age, national origin, membership, or class. Federal law also makes it a point to protect workers in the workplace. This typically covers the application procedure, the hiring and firing of employees, recruitment of employees, employee compensation, employee tenure, layoffs, laws regarding employee leave, and fringe benefits. It also covers disabilities. An employee with a physical or mental disability who can function well at work cannot be discriminated against simply because of his or her disability. An example of this might be an employee who takes medication for a certain psychological disorder, such as depression, or someone who has epilepsy.

Education law is the area of the law that specifically deals with public schools, the school systems, and the school boards charged with educating our children. Many individual state constitutions make the public schools a responsibility of the state or local government. Obviously, this is an important area of law that is a key topic for many of us.

Military law, obviously, has to do with our Armed Forces. The President of the United States is the Commander-in-Chief, who has under him Generals and Admirals, who have under them those who are subject to them, and so on. As someone has wisely said, "No one likes to think that the people with ships, missiles, bombs, planes and guns are not subject to control." It's all part of an orderly and very necessary Government Law.
